Nhiều người thì trách cô gái tại sao lại chấp nhận thực hiện một bộ ảnh quá táo bạo và dễ bị phản ứng thế này? Nhưng không ít người lại cho rằng, chụp như thế nào là quyền của người mẫu. Khi thực hiện bộ ảnh, cô gái cũng đã phải ý thức về việc mình làm. Tuy nhiên, việc tung nó ra khi chưa được sự đồng ý của người mẫu thì hoàn toàn là lỗi của người chụp. Do vậy, luật sư Tín cho rằng hành vi đăng tải bộ ảnh này lên mạng được xem là phát tán nội dung đồi trụy lên mạng căn cứ theo khoản 1 Điều 253 Bộ luật hình sự khoản 2, điều 31 Bộ luật dân sự BLDS 2005 thì cá nhân có quyền đối với hình ảnh của mình, việc sử dụng hình ảnh của cá nhân phải được người đó đồng ý; trong trường hợp người đó đã chết, mất năng lực hành vi dân sự, chưa đủ 15 tuổi thì phải được cha, mẹ, vợ, chồng, con đã thành niên hoặc người đại diện của người đó đồng ý, trừ trường hợp vì lợi ích của Nhà nước, lợi ích công cộng hoặc pháp luật có quy định khác."Căn cứ khoản 2 Điều 31 BLDS thì việc nhiếp ảnh đăng toàn bộ ảnh lên mạng phải có sự đồng ý của người mẫu. Nếu không có sự đồng ý của người mẫu thì căn cứ theo khoản 2 và 3 Điều 25 BLDS, người mẫu có quyền yêu cầu người vi phạm hoặc yêu cầu cơ quan, tổ chức có thẩm quyền buộc người vi phạm chấm dứt hành vi vi phạm, xin lỗi, cải chính công khai; yêu cầu người vi phạm hoặc yêu cầu cơ quan, tổ chức có thẩm quyền buộc người vi phạm bồi thường thiệt hại. Như vậy, nhiếp ảnh có thể bị buộc chấm dứt hành vi vi phạm, xin lỗi, cải chính công khai hoặc bị buộc bồi thường thiệt hại", luật sư Tín cho cạnh đó, luật sư cũng thông tin thêm rằng, nếu người mẫu chưa đủ 15 tuổi thì việc đăng ảnh phải được sự cho phép của cha, mẹ, vợ, chồng, con đã thành niên hoặc người đại diện của người đó. Việc đăng ảnh của người mẫu chưa đủ 15 tuổi mà không có sự đồng ý của ba mẹ người đó thì đã vi phạm khoản 2 Điều 31 BLDS. "Trong trường hợp mẫu suy sụp, sốc vì bị tung ảnh như này lên hay còn gọi là tổn thất về tinh thần thì ngoài việc cải chính công khai và bồi thường thiệt hại tại khoản 1 Điều 611 BLDS, căn cứ khoản 2 Điều 611 BLDS, khoản c, điểm Mục 3, Phần II, Nghị quyết số 03/2006/NQ-HĐTP ngày 08/7/2006 của Hội đồng Thẩm phán Tòa án nhân dân tối cao hướng dẫn áp dụng một số quy định của Bộ luật Dân sự năm 2005 về bồi thường thiệt hại ngoài hợp đồng nhiếp ảnh còn phải bồi thường một khoản tiền bù đắp tổn thất về tinh thần mà người mẫu gánh chịu. Longissimus cervicis is the middle portion of the muscle, located between longissimus capitis and longissimus thoracis. Longissimus thoracis, which is the most caudal part and the most prominent component of the erector spinae muscle group. Longissimus thoracis is divided into a lumbar and thoracic portion. Some sources claim that the lumbar portion of longissimus thoracis is an independent fourth part of the longissimus muscle, named longissimus lumborum. However, it is more widely accepted as a part of longissimus thoracis. Despite being seemingly different, these parts of the longissimus muscle follow a typical pattern of attachment in which they originate at the transverse elements, and insert into the costal elements of a given vertebral segment. In the cervical region, this pattern is represented by the transverse process and posterior tubercle; at the thoracic segments by the transverse process and the posterior surface of the immediately adjacent rib; and at the lumbar segments by the accessory process and medial half of the transverse process. Origin and insertion Longissimus capitis arises from the transverse processes of the first 4-5 thoracic vertebrae T1-T5, and ascends superiorly across the lateral surface of the semispinalis capitis muscle. Along the way, it attaches to the transverse processes of the last 3-4 cervical vertebrae C4-C7. Longissimus capitis finally inserts at the lateral surface of the mastoid process of the temporal bone, adjacent to the attachments of the sternocleidomastoid and splenius capitis Longissimus cervicis originates from the transverse processes of the first 5 thoracic vertebrae T1-T5. It ascends between the tendons of longissimus capitis and longissimus thoracis to insert at the posterior tubercle of the transverse processes of vertebrae Longissimus thoracis is divided into a lumbar and thoracic portion, each one having its own set of origins and insertions Lumbar portion - is usually composed of 5 fascicles, most of which originate from the lumbar intermuscular aponeurosis which is attached to the medial end of the iliac crest. These fascicles ascend and insert into the accessory and transverse processes of vertebrae L1-L4. The inferior most fascicle arises separately from the lumbar intermuscular aponeurosis at the medial part of sacropelvic surface of ilium and the posterior sacroiliac ligament. It inserts into the accessory and transverse processes of vertebra L5. Thoracic portion - contains 11-12 fascicles arranged in a tiered fashion across the length of the posterior thoracic wall. Some fascicles originate from the spinous and transverse processes of vertebrae L1-L5 and their supraspinous ligaments. They ascend and insert into the transverse processes of vertebrae T1-T6. Other fascicles originate from the median sacral crest, posterior surface of the sacrum and the posterior iliac crest. They ascend and insert into the transverse processes of vertebrae T7-T12, as well as the angles of adjacent ribs. Relations The longissimus muscle is a deep muscle of the back that spans the entire length of the vertebral column. It assumes a central position within the erector spinae group, in between the spinalis and iliocostalis muscles. It is found on either sides of the vertebral bodies, running superficial to the transversospinalis and spinalis thoracis muscles. Longissimus is located deep to the splenius capitis, splenius colli, iliocostalis thoracis, iliocostalis lumborum muscles, and erector spinae aponeurosis. Close to its insertion point onto the temporal bone, longissimus capitis lies adjacent and deep to the sternocleidomastoid and splenius capitis muscles, which are also attached to the lateral surface of the mastoid process. The occipital artery runs close to this attachment point of the longissimus. Longissimus capitis is also adjacent and superficial to the posterior belly of digastric muscle, which is attached on the deep mastoid notch on its medial surface. This quarter, Loeb's 13F portfolio value increased from $ to $ The 13F portfolio is very concentrated with the top three holdings accounting ~41% of the entire portfolio. The number of holdings increased from 44 to 46. 23 of the holdings are significantly large more than ~ of the portfolio each and they are the focus of this article. The largest five individual stock positions are PG&E, Colgate-Palmolive, Danaher Corp., Bath & Body Works, and Alphabet. Third Point returned negative in Q1 2023 compared to for the S&P 500 Index. Jaws Mustang Acquisition JWSM The very small stake in JWSM was disposed during the quarter. Stake Increases PG&E Corp. PCG & Units PCG is currently the largest 13F stake at ~17% of the portfolio. The position came about as a result of participating in a PIPE terms for the bankruptcy exit financing in 2020 called for up to $ per share purchase price. The last several quarters saw only minor adjustments. The stock currently trades at ~$17. Danaher Corp. DHR The top three ~11% DHR stake was established in Q3 2015 at prices between $ and $ and increased by two-thirds in Q1 2016 at prices between $62 and $74.
